LA CONTRATACIÓN ADMINISTRATIVA IRREGULAR EN LAS ENTIDADES LOCALES. LA UTILIZACIÓN INDEBIDA DE LA REVISIÓN DE OFICIO COMO MECANISMO DE REACCIÓN
Constituye el objeto de la presente ponencia el estudio de la contratación administrativa irregular, ejemplificada habitualmente en los contratos verbales, las prórrogas tácitas o las modificaciones acordadas al margen del procedimiento legal establecido, desde el punto de vista de las vías que ofrece el ordenamiento jurídico para reaccionar frente a la misma y su relación con el derecho del contratista a obtener una compensación por las prestaciones realizadas y cuya facturación se reclama posteriormente a la Administración.
The purpose of this paper is to study irregular administrative contracting, usually exemplified in verbal contracts, tacit extensions or modifications agreed outside the established legal procedure, from the point of view of the ways offered by the legal system to react to it and its relationship with the contractor's right to obtain compensation for the services provided and whose invoicing is subsequently claimed from the Administration.
We will focus our analysis on the most recent line of doctrine which, especially from certain advisory authorities, has insisted on using the procedure for the review of null and void acts, a position on which we will formulate a critical judgement. Against this, we will defend and specify those cases in which it would be more appropriate to resort to the extrajudicial recognition of credits procedure and the doctrine linked to the principle of unjust enrichment without cause as an autonomous and sufficient source that justifies the payment of the compensation due to the contractor.
