EL DERECHO DE ACCESO A LA JUSTICIA: ESPECIAL REFERENCIA A LOS GRUPOS VULNERABLES
En el presenta artículo se analiza la relación de la Administración de Justicia con personas que tienen alguna discapacidad física visual o auditiva o psíquica . Se tratan los problemas que surgen por las especiales necesidades que adaptación al lenguaje, a la comprensión de los procedimientos e incluso al acceso a los edificios o contenido de los documentos y las posibles soluciones que dota el sistema para garantizar el acceso a la justicia. Se menciona la inclusión de nuevas figuras como el facilitador y la necesidad de formación y adaptarse a las nuevas tecnologías que conceden herramientas útiles para conseguir este objetivo de justicia accesible. Las garantías procesales deben otorgarse al ciudadano tanto que actúa como parte activa como pasiva en el proceso.
This article analyzes the relationship of the Administration of Justice with people who have some physical, visual, auditory, or mental disability. It addresses the problems that arise from the special needs related to language adaptation, understanding of procedures, and even access to buildings or the content of documents, as well as the possible solutions provided by the system to ensure access to justice. It mentions the inclusion of new roles such as facilitators and the need for training and adaptation to new technologies that provide useful tools to achieve the goal of accessible justice. Procedural guarantees must be granted to citizens both when they act as active participants and as passive participants in the process.
