EL ACTO DE CERTIFICACIÓN: ANÁLISIS DE LA FUNCIÓN CERTIFICANTE DEL SECRETARIO DE LOS ÓRGANOS COLEGIADOS DE LAS ADMINISTRACIONES PÚBLICAS.
Ex lege, la función del secretario del órgano colegiado deduce responder a principios de objetividad e imparcialidad, de capacidad e idoneidad, por sus necesarios conocimientos en Derecho para el ejercicio de dicha función de «fe pública». Función de naturaleza medial o instrumental hacia otras, públicas o privadas, en que, por razones de seguridad jurídica e interés general, se haga necesaria constancia de certeza.
Ex lege, the function of the secretary of the collegial body must respond to principles of objectivity and impartiality, of capacity and suitability, due to his necessary knowledge in Law for the exercise of said function of ‘public attesting’. This function is a means and a valid tool towards others, public or private, in which, for reasons of legal certainty and general interest, a proof of certainty is needed.
